Protection and occupation orders under the Domestic Act; Act 732

A person referred to in this Act as an applicant may apply to a court for a protection order to prevent i) another person referred to in this Act as the respondent ii) a person associated with the respondent or both a respondent and a person associated with the respondent from carrying out a threat of domestic violence against the applicant or to prevent the respondent or both from further committing acts which constitute domestic violence against applicant.

 

Occupation order: where the court in issuing a protection order considers it expedient to issue an occupation order, the court may issue the order requiring the respondent to vacate the matrimonial home or any other specified home.
